Limited Warranty/Return Procedures

TIRE MART, INC. (dba PIT BULL TIRE COMPANY, aka "PIT BULL") STANDARD LIMITED WARRANTY - ON PIT BULL® NON-RACING TIRES:

What Does This Warranty Cover?

This Warranty covers substantial defects in workmanship and material in every first (1st ) quality non-racing tire bearing our PIT BULL® brand name and serial number.

This warranty exists during the shorter of the life of the original tread design or SIXTY (60) MONTHS from the date of manufacture as encoded on the sidewall of the tire. At that time, all warranties, express or implied, expire.

Original tread design life is completed when the tire is worn to 2 remaining 32nds.

Tread Wear Protection - only available on PBX A/T Hardcore LT tires (limited 40K warranty):

The following Tread Wear Limited Warranty is a prorated warranty (there is no free replacement period) based on mileage received, and is separate from the standard coverage stated in “What Does This Warranty Cover?” No manufacturer or dealer can guarantee a certain number of miles from a given tire. Driving habits, driving conditions, tire and vehicle maintenance all play a part in the tread life of a tire and all differ with each purchaser.

The Tread Wear Limited Warranty is available provided that you:

1. are the original owner

2. have driven no more than the warranted miles specified in “What Does This Warranty Cover?”

3. have properly serviced and maintained the tires, with periodic rotation, all evidenced by acceptable service records

4. installed the tires no more than 60 months from the date of purchase

5. have treads that are evenly worn down to the top of the tread wear indicate bars

6. present the tire for adjustment.

7. present this Warranty Booklet when requesting an adjustment and your original purchase receipt, date of purchase, vehicle type, model, odometer reading and rotation record are properly recorded.

If the tire wears to the tread wear indicators in less than the miles warranted, a pro-rated adjustment will be made according to actual mileage delivered. Your replacement cost will be determined by dividing the actual mileage delivered by the miles warranted and multiplying the result times the current selling price of an equivalent tire. You must pay for mounting and balancing and any other additional charges, such as taxes or the acceptance of a higher priced replacement tire.

Tread Life

When the tread becomes worn to 2 remaining 32nds anywhere on the tire (shown by tread wear indicators molded into the tread grooves), the tire is worn out. WARNING—for important safety information, you must read the section titled Tire Safety Warnings section of this Warranty Booklet.

How to Obtain an Adjustment

Tire adjustments must be presented to your local PIT BULL ® DEALER . You must present this Warranty Booklet, proof of purchase and be the original owner when requesting a replacement for your tire. See “ How Do You Get Service?"

What Does This Warranty Not Cover?

This Warranty does not cover any of the following:

Any PIT BULL® tire branded as "NA" (non-adjustable) or sold "As-Is" non-adjustable ("NA").

Any PIT BULL® tire sold exclusively for or used for a Racing application of any kind.

Damage, defects, or abnormal wear resulting from any alteration, modification, abuse, or misuse of your PIT BULL® tire, including, but not limited to, the following: improper mounting, improper repair, vehicle wheel misalignment, filled tires, tire/wheel assembly imbalance, non-use, flat spotting from improper storage, ozone or weather checking, vandalism, non-conforming rims, racing, overloading, improper balancing, added material, spinning, trued tires, under or over inflation, under or over weighting, run flat, wheel alignment, siping, grooving, cutting or any other alteration, vehicle suspension alteration, improper vehicle maintenance, improper tire maintenance, lack of regular tire rotation in accordance with industry prescribed rotation patterns and practices, intentional tire damage, use of insert devices, or other causes beyond Tire Mart, Inc.’s control.

NOTE: Alterations such as added siping, tread cutting or insert devices increase the possibility of sudden tire failure which can result in serious injury or death. Do not make alterations to the tire itself. PIT BULL® tires are manufactured to comply with Federal Standards. Alterations to tires are dangerous.

Injuries to your PIT BULL® tire resulting from any of the following, including, but not limited to: road hazards, collisions, accidents, fires, chemical corrosion, impact breaks, damage in shipment (i.e., forklift cuts), cut by vehicle/vehicle projection rubbing, nail holes, cuts, snags, bruises, punctures and similar injuries, or other causes beyond Tire Mart, Inc.’s control.

Appearance or cosmetic defects in tires branded " Blemish. "

Damage or defects resulting from use of bias ply or bias belted tires with radial tires together on the same vehicle.

NOTE : Bias tires ride and handle differently than radials. Bias ply or bias belted tires and radial tires should never be mixed on the same vehicle.

Any loss, damage, expense, inconvenience or incidental or consequential damages of any kind arising out of any defect in or use of your PIT BULL® tire. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion may not apply to you.

NOTE: Any tire, no matter how well constructed, may fail or otherwise become unserviceable due to conditions beyond the control of the manufacturer. Nothing in this limited warranty is intended to be a representation by Tire Mart, Inc. that tire failures cannot occur, or that the failure of a tire is indicative of a defect in materials or workmanship.

NOTE: No Tire Mart, Inc. representative, employee, retailer or dealer has the authority to make or imply any representation, promise, or agreement which in any way varies or modifies the terms of this warranty.

NOTE: THERE IS NO OTHER WARRANTY OR LIABILITY, EXPRESSED OR IMPLIED, APPLICABLE TO THESE PRODUCTS. If Any implied warranty of merchantability or implied warranty of fitness for any particular purpose is imputed by a municipal, state or Federal court or law, then it shall be limited in duration to TWO (2) YEARS from the later of the purchase date or the date of delivery to the purchaser. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Who is Covered by This Warranty?

This warranty covers the original consumer purchaser during the warranty period. This warranty is made for the exclusive benefit of the original consumer purchaser actually using these products and having possession of original sales invoice. This warranty is not assignable, and no warranty claim will be recognized unless submitted on our Standard Claim Form duly filled out and signed by the original consumer purchaser of the tire.

How Long Does Coverage Last?

The coverage of this warranty, except for tire whitewall discoloration issues and dissatisfactory performance due to a balance, out-of-round, or ride complaint issue, lasts for the shorter of the life of the original tread design of your PIT BULL ® tire or SIXTY (60) MONTHS from the date of manufacture as encoded on the sidewall of the tire.

Original tread design life is completed when the tire is worn to 2/32nds of tread remaining.

The percentage that the tire tread design is worn will be determined by taking the average of three measurements around the tire at the fastest wearing groove and pro-rating according to the molded depth measurement of the same groove.

Tire whitewalls are warranted against discoloration for the shorter of the life of the original tread design of your PIT BULL® tire or a period of THIRTY SIX (36) MONTHS from the date of manufacture as molded on the sidewall of the tire.

Your PIT BULL® tire is warranted against dissatisfactory performance resulting from balance, out-of-round, or ride complaint issues only during the first 10% of the tire's original tread design life.

What Will We Do To Correct the Problem?

If a substantial defect in material or workmanship appears in your PIT BULL® tire within the first 10% of the tire's original tread design life, we will provide your Pit Bull Dealer or You (if you bought from us directly) with a credit equal to 100% of their or your purchase price of a new PIT BULL® tire of the same or comparable model (up to the manufacturer's suggested retail price). You will pay the cost of de-mounting the defective tire, mounting the replacement tire, tire stems, balancing and other related items, labor charges and services, any Freight charges (unless we, in our sole discretion, determine to issue a Freight Credit on an Adjustable item), and all Federal, State and Local taxes on the purchase.

It is important to determine if there is a problem within the first 10% of tire wear. A tire that does not deliver satisfactory service due to a balance, out of round or a ride complaint issue may be replaced under the terms above within the first 10 percent of the tire's tread life. Beyond 10% tread wear, these issues are not warrantable.

If a substantial defect in material or workmanship appears in your PIT BULL® tire after the first 10% of the tire's original tread design life, we will provide your Pit Bull Dealer or You (if you bought from us directly) with a pro-rated credit toward the purchase of a new PIT BULL® tire of the same or equivalent model number equivalent to the percentage of the tire's original tread design remaining when the defect appeared. The percentage that the tire tread design is worn will be determined by taking the average of three measurements around the tire at the fastest wearing groove and pro-rating according to the molded depth measurement of the same groove.

The pro-rated credit will be based on the cost of the tire only (up to the manufacturer's suggested retail price), and will not apply to the cost of de-mounting the defective tire, mounting the replacement tire, tire stems, balancing or other related items, labor charges or services, or Federal, State and Local taxes on the purchase.

FOR EXAMPLE: If 75% of the tire's original tread design remains (i.e., the tire's original tread design life is 25% worn), then you will receive a credit of 75% of the dealer's price (up to the manufacturer's suggested retail price) for the tire, excluding the cost of de-mounting the defective tire, mounting the replacement tire, tire stems, balancing or other related items, labor charges or services, any Freight charges, and Federal, State and Local taxes on the purchase. Please Note: Original tread design life is completed when the tire is worn to 2/32nds of tread remaining.

What Will We Not Do?

We will neither replace nor provide a warranty credit for any item for which the purchaser does not submit a Standard Claim Form duly completed and signed by the original purchaser. Additionally, we will neither replace nor provide a warranty credit for any PIT BULL® tire that we determine, at our sole and absolute discretion, has been altered, modified, or siped in any way, has been used for racing, or is not defectively manufactured.

Any modification, alteration, or siping of your PIT BULL® tire will automatically void this warranty.

We will not be liable for or pay for any field charges for labor or other expenses incurred in the replacement of the PIT BULL® tire or any expense incurred by you to remedy any defect in the PIT BULL® tire, including, but not limited to, the following charges: (a) all Federal, State and Local taxes imposed upon the sale of replacement tire; (b) de-mounting the replaced tire; (c) Freight Charges; (d) mounting and balancing the replacement tire, and (e) other related services and charges for parts and labor.

How Do You Get Service?

To obtain warranty service, you must first contact your local PIT BULL ® DEALER.

You must present the original invoice and you must make the vehicle on which the tires were used available for inspection.

Your dealer will have you fill out a
Standard Claim Form. All Standard Claim Forms can be obtained from your local authorized PIT BULL® tire dealer. The section titled "So How Do I Return Something" spells out what the Consumer and Dealer must do to fill out an Adjustment Claim.

If there is no freight involved or if your local dealer requests it, please return your PIT BULL® tire to your local PIT BULL® tire dealer, present your original invoice & the vehicle on which the tires were used for inspection, and complete & sign a
Standard Claim Form, otherwise known as an Adjustment Inspection Report (AIR) or a Return Goods Authorization form (RGA).

Do not ship tires directly to a PIT BULL® dealer nor Tire Mart, Inc. without receiving permission. Neither Tire Mart, Inc. nor our dealers will accept such tires, and you will be responsible for all charges without an RGA# (Returned Goods Authorization number), prior approval & product return instructions and a signed Standard Claim Form duly submitted prior to shipment.

DISCLAIMER OF WARRANTIES ON PIT BULL® RACING PRODUCTS and PIT BULL® NON-RACING PRODUCTS USED FOR RACING. NO WARRANTY POLICY:

TIRE MART, INC. OFFERS RACING PRODUCTS UNDER THE "PIT BULL" BRAND FOR SALE UPON THE TERMS AND CONDITIONS CONTAINED IN THIS DISCLAIMER OF LIABILITY. Due to the many varied and different conditions to which racing lubricants, tires, tubes and wheels ("Racing Products") are exposed, and because of the manner in which Racing is defined and conducted, TIRE MART, INC. MAKES ABSOLUTELY NO WARRANTY, EXPRESSED OR IMPLIED, OF MERCHANTABILITY OR OF FITNESS FOR A GENERAL OR PARTICULAR PURPOSE IN CONNECTION WITH ANY OFFER FOR SALE OR SALE OF PIT BULL® BRANDED RACING PRODUCTS BY TIRE MART, INC.. ALL TIRE MART, INC. PIT BULL® PRODUCTS ARE SOLD "AS IS." PIT BULL ® non-racing products used in or for a Racing application of any kind, void any and all warranties above. Tire Mart, Inc. makes absolutely no warranty, expressed or implied, as to the fitness, merchantability, design, condition, capacity, performance or any other aspect of its Pit Bull® Racing Products or Pit Bull® non-racing products used for racing, or the related materials or workmanship. Tire Mart, Inc. HEREBY EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. Tire Mart, Inc. further disclaims any liability for loss, damage, or injury to purchasers of PIT BULL® Racing Products or Pit Bull ® non-racing products used for racing, or to third parties, as a result of any defects, latent or otherwise, in the PIT BULL® Racing Products or Pit Bull ® non-racing products used for racing, whether arising from negligence or application of the laws of strict liability. Racing Products are not tested or labeled to meet FMVSS 109 standards and therefore it is illegal to sell Racing Products for use on public highways. Any person selling PIT BULL® Racing Products for highway use agrees to indemnify and reimburse Tire Mart, Inc. for all loss, damage or liability Tire Mart, Inc. may suffer because of such sales.

WARNING: DO NOT, UNDER ANY CIRCUMSTANCES, MOUNT A PIT BULL® RACING TIRE ON A WHEEL THAT DOES NOT MEET TIRE AND RIM ASSOCIATION STANDARDS.

Also, Race Tires are not warranted as racing is often performed on severely underinflated tires. Additionally, the use of softeners (which we strongly advise against for safety purposes) can lead to tread blisters and tread and ply separations. Race Tires are regularly inspected on return to us and any Racing Product showing a defect in workmanship or materials is replaced. Our inspectors are very skilled at differentiating between damage and defect. Returning a tire you have damaged and claiming it to be defective is a waste of our time and your money.

New, unused Race Tires exhibiting a defect in workmanship or materials, as verified by Tire Mart, Inc.'s examination, will be issued a credit equal to Tire Mart, Inc.'s PIT BULL branded equivalent tire's distributor price. To qualify for a credit, the tire must have a manufacturing date within twelve (12) months of the tire's return to Tire Mart, Inc.

US/Canada (MAP) Minimum Advertised Price Policy

Introduction

Tire Mart, Inc., dba Pit Bull Tires (hereinafter “Pit Bull”) is a leading provider of tires & wheels for various applications.

We recognize that our high-quality dealers invest time and resources to deliver an extraordinary customer experience through knowledgeable staff and compelling vendor presentation. To support our resellers’ efforts, Pit Bull wishes to establish policies that allow resellers to earn the profits necessary to maintain the high level of customer excellence people have come to expect from Pit Bull dealers.

To protect the investment of our high-quality dealers and Pit Bull’s brand reputation, we have unilaterally adopted a MINIMUM ADVERTISED PRICE POLICY (“MAP Policy”). Pit Bull established this MAP Policy due to the fact that reseller advertising and sales practices that promote Pit Bull products primarily on the basis of price could be detrimental to resellers’ service and support efforts and Pit Bull’s competitive position. Such activities can be harmful to Pit Bull’s brand, reputation and competitiveness, and allow some resellers to take advantage of the service and support efforts of others. Pit Bull believes that these practices are unfair and thus discourages such efforts.

Pit Bull, in its unilateral discretion, may not do business with any reseller, as to the products covered by this MAP Policy, if that reseller intentionally advertises any MAP Product below its MAP price. Pit Bull is confident that this program will strengthen its competitiveness and benefit all of its resellers.

Official Policy and Guidelines

Additional guidelines related to the US/Canada MAP Policy are as follows:

1. Pit Bull reserves the right, in its unilateral discretion, to take other action with respect to any reseller that violates this MAP Policy.

2. The MAP Policy will be enforced by Pit Bull in its sole discretion. Dealers will be warned for first-time violation, and if not corrected, may be subject to termination based on Pit Bull’s sole unilateral discretion.

3. Pit Bull recognizes that any authorized Pit Bull account can make its own decisions to advertise and sell any Pit Bull product at any price it chooses without consulting or advising Pit Bull. Pit Bull similarly has the right to make its own independent decision regarding product allocations and reseller participation as a member of the Pit Bull Authorized Reseller Program – at any time.

4. Pit Bull will maintain an updated “MAP Products” list of those products that will fall under this MAP Policy. Pit Bull reserves the right to update or modify this list at any time. All items listed on Pit Bull Jobber Lists & Master Price Lists are automatically considered included under the MAP policy at each product lines’ respective MAP On Factor level & MAP Price level as indicated by Pit Bull, and as part of the MAP Products Price listing.

5. All Products listed will have a MAP price level determined by a MAP On Factor or the MAP PRICE as listed on a Price list MAP Column, provided by Pit Bull. Listing a price other than the MAP price next to the featured MAP Product in any advertising will be viewed as a violation of this MAP Policy. This MAP Policy applies to all advertisement of MAP Products in any and all media, including, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines catalogs, mail order catalogs, internet or similar electronic media including websites, forums, email newsletters, email solicitations, television, radio, and public signage. Such website features as “Click for price”, automated “bounce – back” pricing e-mails, pre-formatted e-mail responses, forms, automatic price display for any items prior to being placed in a customer’s shopping cart, and other similar features are considered to be communications initiated by the reseller (rather than by the customer) and this constitutes “advertising” under this MAP Policy. This MAP Policy also applies to any activity which Pit Bull determines, in its sole discretion, is designed or intended to circumvent the intent of this MAP Policy, such as solicitations for ‘group purchases’ and the like.

6. It shall NOT be a violation of this MAP Policy to advertise in general that the reseller has “the lowest prices” or will match or beat its competitors’ prices, or to use similar phrases; so long as the reseller does not include any advertised price below MAP and otherwise complies with this MAP Policy.

7. From time to time, Pit Bull may permit resellers to advertise MAP Products at prices lower than the MAP retail price. In such events, Pit Bull reserves the right to modify or suspend the MAP retail price with respect to the affected products for a specified period of time by providing advance notice to all resellers of such changes.

8. From time to time Pit Bull may offer a direct manufacturer’s discount, coupon, gift card, special, incentive, promotion and/or rebate to customers. In such events, it shall not be a violation of this MAP Policy for Pit Bull to advertise the availability of the manufacturer’s discount, coupon, gift card, special, incentive, promotion and/or rebate.

9. Where Pit Bull products are bundled with or sold as part of a package that includes other products, it shall be a violation of this MAP Policy to sell or advertise the bundle (or package) at a price that violates the letter or spirit of the MAP Policy. It shall be a violation of this MAP Policy if products are bundled with or sold as part of a package that includes products not pre-approved by Pit Bull.

10. It shall be a violation of this MAP Policy to include in any advertising for Pit Bull Products any additional discount, coupon, gift card, or incentive (whether in the form of a special event, promotion, term of doing business or otherwise) that translates into an immediate price reduction, where the cumulative effect would be to reduce the advertised price of any MAP Product below MAP. Advertising that includes an additional discount, coupon, gift card, points, or any other incentive for future purchases (regardless of whether the future purchases is of a Pit Bull product) shall be evaluated under the same guidelines as described in Section 9 regarding product bundling. For example, a gift card redeemable on a future purchase would be considered an “other product” under Section 9. This Section 10 shall not apply to any manufacturer’s rebate from Pit Bull on Pit Bull Products or its partners’ products.

11. It shall NOT be a violation of this MAP Policy to advertise that a customer may ”call for price” or “email for price”, or to use similar language, specifically with respect to Pit Bull Products, so long as no price is listed.

12. It shall NOT be a violation of this MAP Policy to advertise free shipping.

13. If a reseller with multiple store locations violates this MAP Policy at any particular store location, then Pit Bull will consider this to be a violation by all of the reseller’s locations.

14. Although resellers remain free to establish their own resale prices, Pit Bull reserves the right to cancel all orders and indefinitely refuse to accept any new orders from any resellers following Pit Bull’s verification that such reseller has advertised any MAP Products at a net retail sales price less that the then-current MAP retail price established by Pit Bull, or if reseller has violated this policy in any other way.

15. Pit Bull may alter, amend or suspend all or part of it’s MAP policy unilaterally and without notice. Pit Bull may alter, amend or suspend this MAP policy on a case by case and customer by customer basis unilaterally and without notice.

16 . Pit Bull’s sales representatives are NOT permitted to discuss this Policy or make any agreements or assurances with respect to Pit Bull’s Policy regarding reseller advertising or pricing. This also includes any consumer program or promotion that affects the below-listed MAP Products.
